1.1 Welcome to TyreLife Solutions. These Terms and Conditions apply to your use of our Website and all purchases of tyres, wheels, and accessories through our online store. By accessing this Website and placing an order, you agree to be bound by these terms. If you do not agree to all of these terms, do not access, use or place an order on our Website.
2. Definitions
2.1 “ECTA” means the Electronic Communications and Transactions Act, 25 of 2002;
2.2 “PAIA” means the Promotion of Access to Information Act;
2.3 “POPIA” means the Protection of Personal Information Act, 4 of 2013;
2.4 “Product” and “Products” means products purchased on our Website through our online store;
2.5 “The CPA” means the Consumer Protection Act 68 of 2008;
2.6 “The/this/our Website” means https://tyrelifesolutions.co.za and includes the homepage and any other sub-pages thereon; and
2.7 “Tyrelife Solutions”, “we” and “us” means Top Draw Tyres (Pty) Ltd trading as Tyrelife Solutions, registration number: 2011/138904/07.
3. Disclosures in terms of Section 43 of ECTA
3.1 In terms of section 43 of ECTA, we record that our details are as follows:
3.1.1 Top Draw Tyres (Pty) Ltd t/a TyreLife Solutions
4.1 These Terms comply with the CPA, POPIA, ECTA and PAIA.
4.2 No provision in these terms shall be interpreted or construed as excluding or waiving any rights which you may have in terms of the CPA, POPIA, ECTA or PAIA (as may be amended from time to time) or any other applicable laws.
4.3 These terms are valid, binding and enforceable in terms of sections 11 and 12 of ECTA and common law.
4.4 By accessing and/or registering on our Website, you agree that you have read and understand these terms and agree to be bound by them without modification.
4.5 You agree and acknowledge that the consent provided in paragraph 4.4 hereof satisfies the “in writing” requirements in ECTA.
4.6 You agree that such agreement is concluded at Durban, South Africa, at the date and time on which you access our Website.
5. Registration and Use of the Website
5.1 You may purchase goods as a registered user or via guest checkout.
5.2 Certain features may require registration.
5.3 To register, you must provide a unique username and password and accurate personal details.
5.4 You are responsible for maintaining the confidentiality of your login credentials.
5.5 You agree that:
5.5.1 Your account is for personal use only;
5.5.2 You will not share your login details with anyone else;
5.5.3 You will notify us immediately if you suspect unauthorised access to your account; and
5.5.4 We shall not be held responsible for any losses or damages sustained by you as a result of the unauthorised use of your login credentials by a third party, or your failure to keep your login credentials secure.
5.6 You acknowledge that your use of our Website and its contents are at your own and exclusive risk.
5.7 We shall not be any liable to you or any third party for any direct, indirect or consequential damages, including loss of profits, or any other damages of any kind, whether based on warranty, contract, delict (including negligence) or otherwise, as a result of your use of the Website.
5.8 We may terminate your account and suspend your access to our Website in the event that you fail to comply with these terms and conditions.
5.9 We reserve the right to terminate or suspend your account for any reason, in our sole and absolute discretion, and without any prior notice.
5.10 You shall not:
5.10.1 Use the Website for unlawful, illegal or immoral purposes;
5.10.2 Interfere with its functionality using any device, software, or process;
5.10.3 Copy or scrape data without our written consent; or
5.10.4 Distribute offensive, defamatory, or harmful content on or using our Website.
5.11 Subject to the provisions of the Regulation of Interception of Communications and Provision of Communication-related Information Act 70 of 2002, we have the right to intercept, block, filter, read and delete all communications sent to or posted by you on our Website.
6. User Age & Legal Capacity
6.1 By using the Website, you warrant that you are 18 years or older and legally capable of entering into a binding agreement.
6.2 If under 18, you may use the site only under the supervision of a parent or legal guardian, who agrees to be bound by these terms on your behalf.
7. Pricing & Availability
7.1 The purchase price shall be the price of the Product as reflected on our Website.
7.2 All prices are inclusive of VAT unless otherwise stated.
7.3 Prices and availability are subject to change without prior notice.
7.4 We reserve the right, without prior notice, to limit quantities or discontinue Products or to change pricing or specifications of Products offered on this Website without incurring any liability whatsoever.
8. Orders & Payments
8.1 Orders placed online constitute your offer to purchase subject to these terms.
8.2 An agreement of sale will only be concluded when payment has been made and the Products have been delivered at your chosen address or handed over to you for collection. This is regardless of any communication from us stating that your order or payment has been received.
8.3 By clicking the ‘confirm order’ tab on the checkout page, you accept the listed price, quantities and specifications of the Product.
8.4 Payment shall be made in South African Rand and shall be without any deduction or set off, unless we agree otherwise.
8.5 Orders placed through the Website are confirmed via email.
8.6 We accept secure online payments via Paygate.
8.7 Payment can be effected by use of VISA or MasterCard debit or cheque cards, as the case may be.
8.8 Orders are only processed once full payment has been received.
8.9 We reserve the right to cancel orders due to pricing errors, stock limitations, or suspicious activity and shall not be liable for any loss or damage, whether direct or indirect, occasioned by our cancellation of an order.
8.10 If we cancel an order then your payment shall be refunded in full.
9. Ownership and risk
9.1 Risk in and to the Products shall pass to you by acceptance of the Products by you or your authorised representative on delivery or collection.
9.2 Ownership of the Products shall pass to you upon:
9.2.1 Payment being received in full, in the case of Products collected from our premises; or
9.2.2 In the case of deliveries, upon offloading of the Products to the main entrance and/or pavement of your allocated delivery address.
10. Delivery
10.1 We aim, but do not guarantee, to deliver all orders within 3 – 7 working days.
10.2 Delivery times may vary based on location, Product availability, or third-party courier delays.
10.3 There may be costs involved in delivering the Product to you, which will be displayed as a separate delivery charge on the checkout page, prior to you confirming your order.
10.4 Delivery costs may vary due to the value of the order, the delivery address and the date and time of delivery.
10.5 You are liable for the delivery costs of any Products purchased on our Website unless free delivery is applicable to your order at checkout.
10.6 We provide tracking information once your order has shipped.
10.7 You are deemed to have accepted delivery of Products on the earliest of the following:
10.7.1 When you expressly or implicitly communicate that you have accepted delivery of the Products; or
10.7.2 When the product has been delivered to you and you do anything in relation to the Product that would be inconsistent with our ownership of them or after the lapse of a reasonable time, you retain the Product without intimating to us that you have rejected delivery.
10.8 You acknowledge that we make use of third-party courier services.
10.9 Upon delivery or collection of the Product you will be required to satisfy yourself of the nature and quantity of the Products.
10.10 You may be required to sign a delivery note confirming receipt of the Products which shall constitute proof that you have inspected the Products and are satisfied that they accord with your order.
10.11 It is your responsibility to ensure that the delivery address is correct.
10.12 We will not be liable for any damages, losses or additional costs which may be incurred as a result of Products being delivered to an incorrect address which is provided by you.
10.13 Any person other than yourself who receives the Products at the delivery address is presumed to be authorised to accept delivery on your behalf.
11. Product Use & Fitment
11.1 Products must be used for their intended purpose only.
11.2 Incorrect assembly, use or installation of the Products may void the warranty.
11.3 We will not be held liable for any damage, loss or liability resulting from the incorrect assembly, installation or use of any Products purchased on our Website.
11.4 Tyre fitment must be completed by a qualified technician or fitment centre. We recommend using TyreLife-approved fitment partners listed on our Website.
11.5 While we take care to recommend reliable fitment service providers, we shall not be responsible for any service-related issues (including delays, poor service, or damage) or any damage, loss or liability caused by third-party fitment centres.
11.6 If you experience any issues with a third-party fitment provider, please contact us directly so we can assist where possible.
11.7 The use of unauthorised or unapproved third-party fitment providers may void your warranty.
12. Promotions & Discounts
12.1 Promotional codes are valid for a limited time only and may not be used in conjunction with other promotions.
12.2 We reserve the right to cancel or modify any promotion without notice.
13. Intellectual Property
13.1 All content on this Website, including trademarks, text, images, designs, logos, information and databases, is the property of TyreLife Solutions or licensed for use.
13.2 The unauthorised use, copying, distribution, modification or reverse engineering of any content on this Website, including trademarks, text, images, designs, logos, information and databases is strictly prohibited.
13.3 No person may use any content on this Website, including trademarks, text, images, designs, logos, information and databases and the like, whether as hyperlinks or for any other purpose, without our prior written consent.
14. Limitation of Liability
14.1 Neither we, nor any of our directors, employees, service providers and agents, shall be liable for any damage, loss or liability of any nature whatsoever, whether indirect, incidental, special or consequential, suffered by you as a result of:
14.1.1 Access to or use of our Website or the contents thereof;
14.1.2 Reliance upon the information provided on our Website;
14.1.3 The purchase by you of Products on our Website; and
14.1.4 The use of Products purchased on our Website.
14.2 Without derogating from the generality of 14.1 above, we shall not be liable for any damage, loss or liability arising from:
14.2.1 Viruses that may infect your computer equipment, software or other property when you access the Website. Any content you access through the use of the Website is done at your own discretion and risk; or
14.2.2 The unavailability of, any interruption in, or your use of the Website access for any reason whatever.
14.3 Any limitation of liability contained in these terms does not affect your rights under the CPA or any other applicable legislation.
14.4 Our total liability is limited to the amount paid for the Product in question, except where otherwise required by law.
14.5 Although certain Products sold on our Website may, under certain specifically defined circumstances, be under warranty, the Website itself and all information provided thereon is provided “as is” and without warranty of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, completeness, or non-infringement, as may be allowed in law.
14.6 We have made every effort to display the Products on the Website as accurately as possible, including the images that represent a visual depiction of the Product, features and descriptions, and the Product’s specifications. However, the actual Product delivered may be subject to variations in appearance as the Product’s packaging may differ over time. It remains your responsibility to ensure that the Product you ordered is correct and the Product description and/or model number will always overrule any related images when resolving a dispute about a Product.
15. Warranties
15.1 We offer two warranties on our Products, namely a Mileage Warranty (a Tread-Life Assurance) and Assurance Warranty (a 1-Year Road-Hazard Protection).
15.2 Our Mileage Warranty (Tread-Life Assurance):
15.2.1 Only applies when 4 (four) or more tyres are purchased and fitted in one transaction; and
15.2.2 Is conditional on registration of the warranty, and proper usage and maintenance of the Product under warranty.
15.3.1 Is 12-month, pro‑rata cover for accidental damage, such as damage from a pothole, impact or irreparable puncture, which renders the tyre unserviceable;
15.3.2 Only applies to 1 (one) or more tyres are purchased and fitted in one transaction; and
15.3.3 Is conditional on registration of the warranty, and proper usage and maintenance of the Product under warranty.
15.4 Warranty benefits are determined by purchase conditions, including the size and brand of the tyre, not by the model of the tyre.
15.5 Manufacturer warranties remain separate from our warranties and cover only defects in materials or workmanship as set out in clause 16 below.
15.6 The conditions of all TyreLife Warranties are:
15.6.1 Registration: You or the tyre dealer must register the tyres purchased with us within 5 (five) days of purchase to activate coverage under the warranty.
15.6.2 Proof of Purchase: You are required to produce the original invoice reflecting the purchase date, tyre brand/model, and quantity purchased.
15.6.3 Maintenance and usage: You are required to produce evidence of conscientious care of the tyre/s, including proof of correct inflation, periodic wheel alignment, and rotations at recommended intervals. You are therefore advised to retain full service records.
15.7 Our warranty/es shall be void and you shall be deemed to have waived all benefits under the warranty/ies, in the event of misuse, overloading, racing, competition use, negligent use, or continued use of the tyre/s after damage has already occurred.
15.8 We are not liable for any loss arising from conditions excluded by the applicable warranty, including misuse, neglect, overloading, competition use, or failure to maintain tyres.
15.9 In the event that you wish to institute a warranty claim, then the following procedure shall apply:
15.9.1 Immediately refrain from further use of the affected tyre once damage or a defect is suspected;
15.9.2 As soon as reasonably possible after the damage or defect is first suspected, deliver the affected tyre to an authorised TyreLife dealer or contact us directly;
15.9.3 Provide us with the proof of purchase, warranty registration and conscientious use as referred to in clause 15.6 above;
15.9.4 We will inspect the tyre to confirm the cause of the damage or defect and verify your eligibility for our warranty coverage;
15.9.5 If coverage under our warranty is approved, then:
15.9.5.1 No cash refunds are offered on approved warranty claims;
15.9.5.2 We shall at our sole and absolute discretion either repair the tyre in question or provide you with a pro‑rata credit toward a replacement tyre;
15.9.5.3 The pro‑rata credit referred to in 15.9.5.2 above is calculated using remaining tread life or warranted mileage achieved;
15.9.5.4 The replacement tyre referred to in clause 15.9.5.2 shall, at our sole and absolute discretion, be a similar or equivalent tyre and will also be subject to availability; and
15.9.5.5 Any additional services and charges, such as services for fitment, balancing and alignment of the replacement tyre are for your account unless otherwise stated.
15.9.6 If we do not approve your warranty claim, then a written reason for the refusal will be provided.
15.10 The duration of our warranties are:
15.10.1 Assurance Warranty: The incident must occur within 12 (twelve) months of the original purchase and must be reported promptly (recommended within 7 days).
15.10.2 Mileage Warranty: Claim must be submitted when the tyre tread reaches the legal minimum prematurely. Warranty claims must be made immediately upon reaching wear indicators and within the normal lifespan of the tyre.
15.11 Tyres subject to a warranty claim must be surrendered to us or one of our approved dealer for assessment and may be retained for analysis or manufacturer submission.
15.12 Our maximum liability under any TyreLife warranty is limited to the pro‑rata credit or replacement cost as set out above.
15.13 Tyrelife shall maintain internal logs for warranty registrations, claims, and outcomes.
15.14 We reserve the right to amend warranty terms at any time. Any amendments will not affect claims already accepted or incidents occurring before the effective date of the amendment.
16. Manufacturer Warranties (Goodyear & Cooper)
16.1 Manufacturer warranties cover defects in materials and workmanship only.
16.2 Manufacturer warranties are for a limited period only, typically 5–6 years from manufacture or purchase.
16.3 Manufacturer warranties exclude normal wear and road hazards, such as potholes, uneven road surfaces, impact with obstructions and the like.
16.4 Approved manufacturer defect claims are settled by pro‑rata adjustment based on remaining tread depth.
16.5 TyreLife facilitates manufacturer claims but does not assume any of the relevant manufacturers’ obligations.
16.6 We are not responsible for any loss, damage or liability of any nature whatsoever, whether indirect, incidental, special or consequential, suffered by you as a result of a manufacturer failing to comply with or perform under a manufacturer warranty.
16.7 Remedies, eligibility, and final decisions under manufacturer warranties rest with the manufacturer or their appointed representative.
17. Complaints
17.1 Any complaints regarding an alleged infringement of your rights through the use of the Website, or access by other Website users or third parties, may be referred to info@tyrelife.co.za.
17.2 The following information must accompany your complaint:
17.2.1 The full names and address of the complainant;
17.2.2 The written or electronic signature of the complainant;
17.2.3 Particulars of the right that has allegedly been infringed;
17.2.4 Particulars of the material or activity that is claimed to be the subject of unlawful activity;
17.2.5 The remedial action required to be taken by us;
17.2.6 Telephonic and email contact details, if any, of the complainant;
17.2.7 A statement by the complainant that the information provided is to his or her knowledge true and correct; and
17.2.8 Any order/ reference number allocated to you in respect of said complaint.
18. General
18.1 These terms constitute the entire agreement concluded between you and Tyrelife Solutions and shall take precedence over any disclaimers and legal notices contained in any communications received Tyrelife Solutions from you.
18.2 Any failure by us to exercise or enforce any right or provision of these terms shall in no way constitute a waiver of such rights or provision.
18.3 In the event that any provision in these terms is found to be unenforceable or invalid for any reason, then such term or condition shall be severable from the remaining content which shall remain valid and enforceable.
18.4 This Website is hosted, controlled and operated from the Republic of South Africa and this agreement shall therefore be governed by and interpreted according to the laws of the Republic of South Africa.
